Stark Succeeds in Class Action Litigation

Andrea Stark, working with the lawfirm of Roddy and Klein, in Boston Massachusetts, recently succeeded in defeating a motion to dismiss a class action lawsuit filed on behalf of debtors refinancing their homes who were overcharged by title insurance companies for title insurance.  The case of Campbell v. First American Title Insurance Co. was decided in Federal District Court in Portland Maine, and the decision permits the class action lawsuit to continue against First American.  This success in the lawsuit gives overcharged consumers an opportunity to have a trial in the Federal District Court and asserts claims under the Unfair Trade Practices Act as well as other federal and state statutes.  The case will now proceed in the "discovery" phase, during which both parties will exchange information and documents pertinent to the claims raised in the Campbell complaint.  First American is also being sued for this same overcharging activity in other states around the country.
