Bankruptcy Reform
James F. Molleur's Recent blog articles on BAPCPA:
Bankruptcy Reform- 1 Year Later - November, 2006
Effects of Bankruptcy Reform - August, 2006
When Congress enacted the Bankruptcy Reform Law in October 2005, everyone expected that it would be more difficult to file bankruptcy. The credit card companies rejoiced - they wanted to collect more money from consumers and they had paid enough money to Congress to get the law passed. Consumers would be hounded by debt collectors and discouraged from filing bankruptcy.
The reality has been far different- learn more in a recent posting on my Bankruptcy Blog
Also, I encourage you to read my new article, Winners and Losers of BAPCPA

Consumer Law Violations
My practice has become a strong proponent of consumer rights in Maine. We are willing to explore violations of the Fair Credit Reporting Act (FCRA). If you disagree with notations on your report, both the reporting agency and creditors are required to investigate the claim, and may be held responsible for monetary compensation.
- I also litigate violations of the Fair Debt Collection Practices Act (FDCPA). This act prohibits collection agenicies from harassing consumers or misrepresenting their own legal actions through threats. It also limits calls to third parties and the workplace, and dictates the times which collections calls can be made. A violation of this act will also bring compensation.
- Please schedule an appointment if you feel your consumer rights have been violated.
I have also initiated lawsuits on behalf of consumers using:
- Truth in Lending Act litigation
- Real Estate Settlement Practices Act litigation
Chapter 7 Bankruptcy
- Liquidation may be the best solution for your debt. Take a look at this outline of Chapter 7 in Maine and my related resources.
Chapter 11 Bankruptcy
I have represented small corporations and individual business owners through Chapter 11 bankruptcy, although my firm is not prepared for larger, expensive and resource-consuming Chapter 11 cases.
- Please see our resources for Businesses experiencing financial distress. There may be a number of options to bring your company out of debt.
- I represent individuals who must file Chapter 11 due to their inability to file a Chapter 13 because of their debt level. Individuals filing Chapter 11 can achieve their goals in protecting their property and discharging their debt.
- Schedule an appointment and together we will form a solution for your businesses debt.
Chapter 12 Bankruptcy
Small-scale farmers can protect their property investments by reorganizing their debt through this form of bankruptcy.
- "Family Farmer Bankruptcy"
- Please schedule an appointment with me if your family farm is in financial distress.
Chapter 13 Bankruptcy
I have helped a number of Maine's individuals and businesses remove their debt and maintain important assets through Chapter 13 Reorganizations.
Violations of Stays and Injunctions
- After you file for bankruptcy you are protected from contact by creditors. If they persist in trying to collect from you, your consumer rights have been violated.
Credit Report Corrections
- Communicating with creditors and credit-reporting agencies is often a difficult part of the bankruptcy process

Creditors
I not only represent debtors in bankruptcy proceedings, but I also represent creditors in filing proofs of claim, objecting to discharge or dischargeability of debts, and defending creditors from preference and fraudulent transfer claims.
